Claims against NEFCO move forward

What happened

NEFCO, the New England Fertilizer Company, and related entities asked the Court to dismiss residents’ claims against them. Residents allege that NEFCO turned sewage sludge into biosolid pellets and sent them to MassNatural.

The Court allowed the negligence and medical monitoring claims against the remaining NEFCO entities to go forward. It dismissed Synagro Technologies from the case. It also dismissed residents’ nuisance, willful and wanton conduct, and Massachusetts General Laws Chapter 21E claims against NEFCO.

What it means for you

Residents’ claims against NEFCO remain part of the case, including the claim for a medical monitoring program. The ruling does not decide whether NEFCO is responsible for any contamination.
